MAY I HAVE THE REPORT FOR ITEM FOUR? A GOOD EVENING CHAIR, VICE CHAIR AND COMMISSIONERS.

I'M CATHERINE LO, BEER DEPUTY DIRECTOR OF PLANNING FOR DEVELOPMENT SERVICES.

SO TONIGHT, ITEM FOUR A IS A PUBLIC HEARING TO CONSIDER THE PROPOSED CITY INITIATED AMENDMENTS TO THE ZONING CODE AND THESE ARE RELATED TO BACKYARD CHICKENS.

AND THEN TO FORWARD A RECOMMENDATION TO CITY COUNCIL, UH, THIS IS THE FIRST OF SEVERAL TEXT AMENDMENTS THAT WE WILL BE BRINGING FORWARD TO YOU, UM, BEFORE THE END OF THIS YEAR IN RESPONSE TO, UH, RECENT CHANGES IN STATE LAW.

SO THE PROPOSED AMENDMENT RESPONDS TO HOUSE BILL 2325, WHICH WAS PASSED BY THE LEGISLATURE, AND IT ALLOWS A RESIDENT OF A SINGLE FAMILY DETACHED RESIDENCE TO KEEP UP TO SIX CHICKENS IN THE BACKYARD.

AND THIS BILL WILL BECOME EFFECTIVE IN, UM, SEPTEMBER 14TH, 2024.

THE PLANNING COMMISSION REVIEWS PROPOSED CHANGES TO CHAPTER 28, WHICH IS THE AVONDALE ZONING ORDINANCE, AND THEN UPDATES TO AVONDALE CITY CODE.

CHAPTER THREE WILL BE SEPARATELY CONSIDERED BY THE CITY COUNCIL AND IT WILL SPECIFICALLY ADDRESS THE KEEPING OF BACKYARD CHICKENS.

SO IN YOUR PACKET, UM, IT HAD A RED LINE VERSION OF THE ZONING CODE AMENDMENTS.

UH, FIRST IN SECTION 28 15, WHICH IS OUR DEFINITIONS, UH, WE ARE ADDING THE DEFINITION OF BACKYARD FOUL AND THAT IS TO BE CONSISTENT WITH STATE LAW AND THE DEFINITION, UM, WILL EXCLUDE ROOSTERS.

WE'RE ALSO REMOVING THE TERM SWINE FROM THE DEFINITION OF FARM ANIMALS BECAUSE OUR CITY CODE ALREADY PROHIBITS THEM.

NEXT IN SECTION 28 33, THIS IS WHERE WE, UH, TALK ABOUT USES, UM, THAT ARE PERMITTED UNDER CERTAIN CONDITIONS.

SO THE LAND USE MATRIX FOR RESIDENTIAL ZONING DISTRICTS, UM, HAS FARM ANIMALS LISTED WITH CONDITIONS IN CERTAIN AREAS.

UM, TYPICALLY IN OUR LARGER LOT, UM, ZONING DISTRICTS AND FOR EXAMPLE, FARM ANIMALS ARE PERMITTED BY W RIGHT IN THE AGRICULTURAL ZONE.

WE'RE GONNA REVISE SUBSECTION G TO INCLUDE BACKYARD FOUL WITH FARM ANIMALS.

AND THEN WE'RE GONNA ADD A CROSS REFERENCE TO AVONDALE CITY CODE CHAPTER THREE, UM, WHICH IS WHERE, UM, THE KEEPING OF LIVESTOCK AND FOUL IS DISCUSSED.

WE'RE ALSO GONNA REMOVE TEXT ABOUT THE KEEPING OF LIVESTOCK, UM, AS THESE REQUIREMENTS WILL BE CONTAINED IN CHAPTER THREE.

AND THEN LAST IN SECTION 28 DASH 1 33 WHERE WE TALK ABOUT DETACHED ACCESSORY BUILDINGS.

WE'RE GONNA REMOVE THE WORD FOUL FROM THE LANGUAGE ABOUT, UM, HEIGHT LIMITATIONS.

UM, BECAUSE THE RECENT CHANGES TO STATE LAW SPECIFY THE MAXIMUM HEIGHT OF A ENCLOSURE CHICKEN ENCLOSURE, AND THAT HEIGHT LIMIT IS EIGHT FEET.

SO WE DID COMPLETE ALL THE REQUIRED NOTIFICATIONS AND THIS ITEM WAS POSTED ON OUR AVONDALE CONNECT PAGE.

WE DID RECEIVE ONE COMMENT FROM THE PUBLIC THAT WAS IN SUPPORT OF MAKING OUR CODE CONSISTENT WITH STATE LAW.

UM, I JUST WANTED TO SHARE THAT OUR MONTHLY DATA FOR THE MONTH OF JULY THAT WE HAVE RECEIVED 23 NEW DEVELOPMENT APPLICATIONS FOR OUR TEAM TO REVIEW.

AND WE ALSO RECENTLY APPROVED A NEW DUNKIN DONUTS IN THE COMMUNITY.

SO YOU SHOULD START SEEING CONSTRUCTION ON THAT.

UH, RIGHT ACROSS THE STREET HERE IN COLDWATER SPRINGS PROMENADE.
