THIS IS APPLICATION PL 24 DASH 0 2 25.
THIS IS A CITY INITIATED TEXT AMENDMENT TO THE AVONDALE ZONING ORDINANCE FOR ACCESSORY DWELLING UNITS OR ADU.
UH, ITEM FOUR A IS TO REVIEW THE PROPOSED ZONING CODE TEXT AMENDMENT, CONDUCT A PUBLIC HEARING, AND FORWARD A RECOMMENDATION TO CITY COUNCIL TO GIVE YOU SOME BACKGROUND ON WHY THIS AMENDMENT IS COMING FORWARD.
EARLIER THIS YEAR, THE ARIZONA LEGISLATURE PASSED HOUSE BILL 27 20, WHICH STANDARDIZED THE REGULATIONS ON ACCESSORY DWELLING UNITS OR ADUS THROUGHOUT THE STATE.
SPECIFICALLY, THE NEW LAW REQUIRED COMMUNITIES WITH MORE THAN 75,000 RESIDENTS TO ALLOW FOR THE CONSTRUCTION OF ADUS ON ANY LOT THAT PERMITS A SINGLE FAMILY HOME.
THE PURPOSE OF THIS ITEM AND TEXT AMENDMENT IS TO ADOPT CHANGES TO THE AVONDALE ZONING ORDINANCE, ALSO KNOWN AS CHAPTER 28 OF THE MUNICIPAL CODE TO ALLOW FOR THE CONSTRUCTION OF ADUS THROUGHOUT THE CITY IN COMPLIANCE WITH STATE LAW.
THE FIRST SECTION TO BE AMENDED IS 28 DASH 15.
THIS SECTION OF THE CODE DEALS WITH DEFINITIONS AND WAS AMENDED TO ADD THE TERMS, UH, ACCESSORY DWELLING, UNIT RESTRICTED, AFFORDABLE DWELLING, AND SHORT AND LONG-TERM RENTALS.
SO AN ACCESSORY DWELLING UNIT FOR REFERENCE IS A SELF-CONTAINED RESIDENTIAL LIVING UNIT THAT IS ON THE SAME LOT OR PARCEL AS A SINGLE FAMILY DWELLING OF GREATER SQUARE FOOTAGE THAN THE ACCESSORY DWELLING UNIT.
AND IT SHALL ALSO PERMIT, UH, OR SHALL ALSO PROVIDE PERMANENT PROVISIONS

FOR LIVING, SLEEPING, EATING, COOKING, AND SANITATION, AS WELL AS A SEPARATE ENTRANCE.ADDITIONALLY, THE DEFINITION OF A DWELLING OR DWELLING UNIT WAS ALSO UPDATED IN SECTION 28 DASH 32 AND 28 DASH 33.
THE LAND USE MATRICES WILL ALSO BE AMENDED TO ADD AUS AS A PERMITTED WITH CONDITIONS USE TO ALL RESIDENTIAL LAND USE DISTRICTS THAT PERMIT SINGLE FAMILY HOMES.
UH, AS FAR AS THE NUMBER OF ACCESSORY DWELLING UNITS THAT'LL BE ALLOWED, THIS IS A BREAKDOWN OF THE DIFFERENT CIRCUMSTANCES THAT WOULD POTENTIALLY PERMIT ADDITIONAL UNITS IN MOST CASES THROUGHOUT THE CITY.
WE'LL HAVE SINGLE FAMILY HOMES THAT PERMIT ONE ATTACHED A DU AS WELL AS ONE DETACHED A DU.
UH, IN THE CIRCUMSTANCES WHERE YOU HAVE ONE OR MORE, OR SORRY, UH, AN ACRE OR MORE OF LAW AREA, YOU'LL BE ALLOWED ONE ATTACHED A DU ONE DETACHED, A DU, AND AN ADDITIONAL DETACHED A DU THAT IS REQUIRED TO BE RESTRICTED, AFFORDABLE, UH, WHICH IS DEFINED IN OUR ZONING ORDINANCE.
SO WHAT ARE SOME OF THE NEW CONDITIONS THAT ARE COMING OUT? WELL, UH, THESE ARE SOME OF THE HIGHLIGHTED CONDITIONS FOR ADUS.
OF THESE, A COUPLE THAT I'D LIKE TO KIND OF GO OVER ARE THE MAXIMUM SQUARE FOOTAGE.
SO THE MAXIMUM SQUARE FOOTAGE OF ANY OF THESE ADUS WILL BE 1000 SQUARE FEET, UH, OR 75% OF THE GROSS FLOOR AREA OF THE MAIN HOUSE.
SO 1000 SQUARE FEET IS THE MAXIMUM, UH, OR 75% OF, OF THE MAIN HOUSE, WHICHEVER SMALLER IS THE MAXIMUM SQUARE FOOTAGE THAT YOU'RE ALLOWED.
UH, ALSO THE MINIMUM SIDE AND REAR SETBACKS FOR THESE UNITS WILL BE FIVE FEET.
UH, THE FRONT SETBACK WILL BE THE SAME AS THE MAIN HOUSE AND THEN THE HEIGHT WILL BE THE SAME AS THE MAIN HOUSE OR WHATEVER THAT ZONING DISTRICT ALLOWS.
IN MOST CASES, THAT'LL BE 30 FEET.
UH, FURTHER AMENDMENTS TO CHAPTER 28 WILL MAKE IT CLEAR THAT NO ADDITIONAL PARKING WILL BE REQUIRED FOR THESE ADUS.
UH, AS A REMINDER, PARKING FOR SINGLE FAMILY DWELLINGS INCLUDES, UH, TWO ENCLOSED GARAGE SPACES AS WELL AS ONE GUEST SPACE, WHICH IS USUALLY PROVIDED BY MEANS OF A DRIVEWAY.
UH, THE SECTIONS OF THE ZONING ORDINANCE THAT ADDRESS DETACHED ACCESSORY BUILDINGS, UH, WILL ALSO BE UPDATED TO REFERENCE THE A DU CONDITIONS.
AS FAR AS PUBLIC PARTICIPATION'S CONCERNED, ALL REQUIRED NOTIFICATIONS WERE COMPLETED AND THERE WAS A POST ON AVONDALE CONNECT.
UH, TO DATE, ONE COMMENT WAS RECEIVED IN SUPPORT ON AVONDALE CONNECT.

2 27 FOR A TEXT AMENDMENT TO THE ZONING CODE REGARDING SPECIFIED TIMEFRAMES FOR THE REVIEW OF NEW RESIDENTIAL REZONE REQUESTS.SO THE PURPOSE OF THE PLANNING COMMISSION PUBLIC HEARING IS TO CONSIDER A CITY INITIATED REQUEST FOR TEXT AMENDMENTS TO THE ZONING ORDINANCE.
TAKE APPROPRIATE ACTION AND FORWARD A RECOMMENDATION TO THE CITY COUNCIL.
THE TEXT AMENDMENT REFINES THE ORDINANCE TO REFLECT RECENT CHANGES IN STATE LAW REGARDING SPECIFIED TIMEFRAMES FOR THE REZONING OF A PROPERTY TO A RESIDENTIAL ZONING DISTRICT.
THE PROPOSED CODE AMENDMENTS RESPOND TO SENATE BILL 1 1 6 2, WHICH WAS PASSED BY THE ARIZONA STATE LEGISLATURE.
THIS SPECIFIES THE TIMEFRAME THAT THE CITY, UH, WILL BRING A RESIDENTIAL REZONE QUEST TO THE CITY COUNCIL FOR ACTION.
THE STATE BILL REQUIRES THAT THE CITY ADOPTS THE, UH, REQUIREMENTS IN THE ZONING ORDINANCE BY JANUARY 1ST, 2025.
TO ENSURE COMPLIANCE WITH STATE LAW, THE SPECIFIED TIMEFRAMES FOR UH, RESIDENTIAL ZONING APPLICATIONS WILL BE ADDED TO THE ZONING ORDINANCE.
SO WITHIN YOUR PACKET CONTAINS THE RED LINE VERSION OF THE ZONING CODE AMENDMENTS.
IN SUMMARY, THE TEXT AMENDMENTS ADD A TIMEFRAME OF 30 DAYS FOR THE CITY TO DETERMINE AND APPLIC, UH, RESIDENTIAL REZONE APPLICATION COMPLETE AND A 180 DAY TIMEFRAME TO BRING THAT APPLICATION TO THE CITY COUNCIL FOR ACTION.
IT ALSO PROVIDES FOR SOME EXCEPTIONS TO THE REQUIREMENT THAT ARE PROVIDED BY STATE LAW AND IT ALSO, UM, PROVIDES A WAY FOR THE APPLICANT TO ASK FOR EXTENSIONS ON THAT TIMEFRAME.
SO ALL PUBLIC NOTIFICATIONS HAVE BEEN COMPLETED.
UM, THE ITEMS WERE PA POSTED ON AVONDALE CONNECT AND ONE COMMENT WAS RECEIVED.
UM, THE COMMENTER JUST REQUESTED THAT THE CITY, UH, DENY ANY NEW MULTI-FAMILY RESIDENTIAL APPLICATIONS IN THE FUTURE.
